I have been a veterinarian for 30 years, and have had similar experiences occasionally, and have found that a sincere apology is not only the right thing to do, but usually effective at defusing the potential for litigation as well.

However, liability insurance carriers have exactly the opposite viewpoint, and might go so far as to refuse to defend a claim for malpractice if an apology has been offered, so apologizing does carry significant risk.
